A JUSTIÇA RESTAURATIVA COMO SISTEMA PARA A RESOLUÇÃO DE CASOS DE VIOLÊNCIA INFANTIL NA FASE DO TRIBUNAL DA ALDEIA EM BALI

Resumo

O foco principal deste estudo é o uso da justiça restaurativa para lidar com crimes de violência contra crianças no âmbito das aldeias tradicionais. A aplicação das leis contra a violência contra crianças nas aldeias tradicionais é crucial para o gerenciamento e a prevenção eficazes desses crimes. A jurisdição dos tribunais de aldeia estabelecidos pelos povos indígenas da Indonésia para lidar com a violência contra crianças utilizando os princípios da justiça restaurativa não está claramente definida no Sistema de Justiça Criminal Juvenil. Este estudo investigará o conceito de justiça restaurativa em conjunto com o pamuput wicara, que é a sabedoria tradicional do povo indígena balinês. Este estudo se concentra em métodos sociojurídicos. As aldeias tradicionais em Bali estabeleceram um sistema de justiça restaurativa nos tribunais de aldeia conhecido como pamuput wicara. Este estudo pode ser usado como um guia para os povos indígenas que buscam melhorar seu sistema de diversão, utilizando ideias de justiça restaurativa e conhecimento tradicional nos tribunais de aldeia para lidar com crimes de violência infantil.
