Reassessing the reasonable suspicion In April 2024, when judging Habeas Corpus 208.240/SP, the Brazilian Federal Supreme Court (STF) established the doctrine that police stops and searches must be based on objective criteria, holding it unlawful for such measures to be based on race, sex, sexual orientation, skin color, or physical appearance. The ruling, however, proved controversial with respect to its practical effects, since in the case at hand the court denied that the stop had in fact been driven by racial profiling. Against this backdrop, this article seeks to reflect on the ruling and its possible practical repercussions. Drawing on a literature review and an examination of the term "reasonable suspicion," the normative category used to assess the lawfulness of a police stop and search, the article discusses the potential implications of the decision for the institutions of the criminal justice system. The findings suggest that, while the ruling marks an important milestone in addressing racial profiling, it also raises doubts about the capacity of the courts to identify and confront such situations in practice.
